These terms govern your use of NOOPS (noops.au), operated by John Allsopp and Mark Pesce ("we", "us", "NOOPS").
By accessing or using NOOPS, you agree to these terms. If you do not agree, do not use the service.
1. What NOOPS is
NOOPS is a technology and market analysis service. We publish commentary, research, signals, and data visualisations about the AI transformation and its implications for technology markets, companies, and industries.
2. What NOOPS is not — important disclaimer
NOOPS does not provide financial product advice within the meaning of the Corporations Act 2001 (Cth). We do not hold an Australian Financial Services Licence. We are not authorised to provide, and do not provide, personal advice or general financial product advice.
Nothing published by NOOPS — including but not limited to daily signals, weekly theses, monthly deep dives, dashboard data, virtual portfolio tracking, editorial commentary, or any other content — should be interpreted as a recommendation to buy, sell, or hold any financial product, security, or investment.
Any references to specific companies, stock tickers, market data, sectors, or financial trends are analytical commentary provided for informational and educational purposes only. They do not take into account the objectives, financial situation, or needs of any particular person.
You should not rely on NOOPS content as the basis for any investment decision. You should seek independent professional financial advice before making any investment decisions.
3. Virtual portfolio
NOOPS may display a hypothetical "virtual portfolio" tracking simulated positions. This portfolio:
- Does not involve real money, real trades, or real investment returns
- Is for educational and illustrative purposes only
- Does not constitute a recommendation to replicate any position
- Past hypothetical performance does not indicate or predict future results
4. No guarantee of accuracy
We make every effort to ensure our analysis is accurate and well-sourced, but we do not guarantee the accuracy, completeness, or timeliness of any content. Technology markets move fast. Information may become outdated between publication and your reading of it.
We are not liable for any errors or omissions in our content, or for any losses or damages arising from reliance on our content.
5. Subscription and payment
NOOPS offers Free, Plus, and Pro subscription tiers. Paid subscriptions are billed monthly or annually as selected at signup. Payments are processed by Stripe. We do not store your payment card details.
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. We do not offer refunds for partial billing periods.
We reserve the right to change pricing with reasonable notice. Existing subscribers will be notified of price changes at least 30 days before they take effect.
6. Your account
You are responsible for maintaining the security of your account credentials. Do not share your login with others.
We reserve the right to suspend or terminate accounts that violate these terms, including sharing subscription content with non-subscribers.
7. Intellectual property
All NOOPS content — including text, analysis, data visualisations, and design — is the intellectual property of John Allsopp and Mark Pesce. You may not reproduce, distribute, or republish our content without written permission.
Paid subscribers may quote brief excerpts with attribution for personal or internal use. Systematic redistribution (e.g., forwarding newsletters to mailing lists, reposting signals to public channels) is not permitted.
8. Limitation of liability
To the maximum extent permitted by law, NOOPS, John Allsopp, and Mark Pesce are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the service or reliance on its content.
This includes, without limitation, any investment losses, trading losses, or financial decisions made in connection with information obtained from NOOPS.
Our maximum aggregate liability for any claim arising from your use of NOOPS is limited to the amount you have paid us in subscription fees in the 12 months preceding the claim, or AUD $100, whichever is greater.
9. Australian law
These terms are governed by the laws of New South Wales, Australia. Any disputes arising from these terms are subject to the exclusive jurisdiction of the courts of New South Wales.
10. Changes to these terms
We may update these terms from time to time. We will notify registered users of material changes via email. Your continued use of NOOPS after changes take effect constitutes acceptance of the updated terms.
